1. Professional Judgment Required
IESE is an estimating aid, not a substitute for professional estimating practice. The user remains solely responsible for the accuracy and suitability of every estimate produced with the Software, including verification of quantities, scope, labor rates, equipment and material pricing, site conditions, productivity assumptions, and the final bid amount.
The manhour database and other values supplied with the Software are reference starting points reflecting the author's experience. They are not guarantees of field production on any particular project. Users are expected to apply proper estimating techniques and procedures — including independent takeoff verification, site-specific adjustment, peer review, and management approval — before relying on any output for a bid, proposal, budget, or contractual commitment.
2. No Warranty
The Software is provided "AS IS" and "AS AVAILABLE," without warranty of any kind, express or implied, including but not limited to warranties of accuracy, completeness, reliability, merchantability, fitness for a particular purpose, or non-infringement. No oral or written information provided by the author shall create any warranty. The author does not warrant that the Software will be error-free or uninterrupted.
3. Limitation of Liability
To the maximum extent permitted by law, the author shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from or related to the use of, or inability to use, the Software — including but not limited to lost profits, lost bids, bid errors or omissions, cost overruns, business interruption, or loss of data — even if advised of the possibility of such damages. You assume full responsibility for all decisions made and actions taken based on the Software's output.
4. Not Professional Advice
Output from the Software does not constitute engineering, financial, legal, or professional estimating services, and no professional relationship is created by its use. Where professional certification, sealing, or review of an estimate is required, that remains the user's obligation.
5. License Terms
- Single Seat license: licensed to one named estimator for use on that estimator's machines. Not transferable between individuals without written consent.
- Company license: licensed to one company for use by its estimating personnel at that company.
- The Software, including its manhour database, structure, and reports, is proprietary to the author. Patent Pending.
- You may not redistribute, resell, sublicense, rent, or publicly post the Software or any portion of it.
- You may not reverse engineer, decompile, or extract the manhour database for use outside the Software or for incorporation into any other product or service.
- Custom items and rates you add to your copy remain yours.
6. Demo Version
The free demo is provided for evaluation only, for the stated trial period, and includes a restricted sample of the manhour database. Demo output is for evaluation and must not be used as the basis for a commercial bid or contractual commitment. The demo may not be redistributed, and the trial mechanism may not be circumvented or reset.
7. Updates and/or Support
Updates and/or support are provided as described at the time of purchase, or under an optional annual maintenance arrangement where offered. The author has no obligation to provide perpetual updates, enhancements, or support beyond what is expressly included with your license or maintenance term. Purchased licenses do not expire.
8. Refund Policy
Purchases are processed by Paddle.com, our merchant of record; Paddle's name appears on your receipt, invoice, and card statement.
The Software is a digital product delivered by download and activated by license key. Because the complete product is delivered immediately and cannot be returned, all sales are final and no refunds are available, except where required by applicable law. A free demo is provided so you can evaluate the Software in full before purchasing; please use it to confirm the Software meets your needs before you buy.
If a refund or chargeback is issued for any reason, the license key is revoked and the download link is deactivated. Questions about a purchase: [email protected].
9. Privacy Notice
We collect only what is needed to deliver and support the Software: your email address, and your company name if you provide it, at demo signup or purchase. Payment details are entered directly with Paddle and never reach us.
Your email address is used to send your download link, license key, and support replies, and is retained so a lost key can be re-issued. We do not sell or share it, and we do not send marketing email unless you opt in at checkout. This site uses Cloudflare's cookie-free, privacy-first analytics to count page views; it does not track individuals. There is no advertising.
The Software itself runs entirely on your own computer. Your estimates are stored only where you save them, and the Software sends nothing back to us. To have your information deleted, email [email protected].
10. General
If any provision of these terms is held unenforceable, the remaining provisions remain in full effect. These terms constitute the entire agreement regarding use of the Software and supersede prior communications on the subject. The author may update these terms for future versions; the terms in effect at the time of your purchase govern your license.
